These Terms of Service (“Terms”) govern your use of the Kendrick website-building service (“Service”) operated by Kendrick Inc. (“Kendrick,” “we,” “us,” or “our”), a California C corporation. By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Public Websites. Kendrick is a service for creating public websites. Everything you send to Kendrick — including text, images, and other content — may be published on a publicly accessible website that anyone on the internet can view. Do not send or ask Kendrick to post anything you consider private, confidential, or sensitive. This includes personal information, passwords, financial details, medical records, or anything else you would not want the general public to see.
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you meet this requirement.
Built for everyday websites. Kendrick is designed for individuals, freelancers, side hustles, and small businesses who need a simple, professional web presence — think portfolios, landing pages, local shops, restaurants, event pages, and personal projects.
Kendrick is not intended as a platform for large-scale enterprises, mission-critical commercial operations, regulated industries (such as healthcare, financial services, or legal compliance), or any use case where website downtime, content inaccuracies, or AI-generated errors could result in significant financial loss, legal liability, or safety risks. If your needs go beyond what a simple informational website can provide, Kendrick is probably not the right fit.
By using the Service, you acknowledge that Kendrick is a lightweight, AI-assisted website builder with inherent limitations, and you agree not to rely on it for business operations where those limitations could cause material harm.
Accounts are created via email verification. You are responsible for maintaining the security of the email address associated with your account and for all activity that occurs under your account. One account per individual is permitted.
You retain ownership of any original text, images, and other materials you provide to Kendrick (“Your Content”). By submitting Your Content, you grant Kendrick a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content solely for the purpose of operating the Service and building your website.
Kendrick retains all rights to the platform, software, generated code, and page templates. Websites are generated with the assistance of third-party artificial intelligence providers, and Kendrick makes no claim of exclusive intellectual property rights over AI-generated output.
The Service uses third-party AI systems to generate website content, including text and images, based on your instructions. AI-generated content may contain inaccuracies, may not perfectly reflect your intent, and may occasionally produce unexpected results. You are solely responsible for reviewing and approving all content before publication. Kendrick does not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service to create, host, or distribute content that is illegal, pornographic, abusive, or otherwise prohibited.
Here’s the deal: Kendrick is a hard worker and a service built to help regular folks get a great website without the usual hassle. He shows up, does the work, and genuinely tries his best. But — like the rest of us — he’s not perfect. Sometimes things won’t land exactly right on the first try, and that’s okay.
That said, if your use of the Service starts to feel less like “building a website” and more like something unusual, excessive, or otherwise outside the spirit of normal use — in other words, if things stop feeling regular and start feeling too intense — Kendrick reserves the right, at his sole and reasonable discretion, to slow down, pause, or discontinue work on your request. No hard feelings, no drama. Just keep it mellow and everything will work out. That’s Kendrick’s commitment to you.
Kendrick is a new and growing service, and we’re adding features all the time. That said, there are things we don’t support yet — like e-commerce, user accounts, forums, or databases. If any of those are critical for you right now, another platform might be a better fit today. No hard feelings — and we’d love to have you back as Kendrick keeps growing.
For the avoidance of doubt, this clause supplements (and does not limit) our Acceptable Use Policy and content moderation rights described elsewhere in these Terms. Kendrick Inc. may exercise this discretion without prior notice and without liability, provided such exercise is not arbitrary or discriminatory.
Kendrick reserves the right to review, remove, or refuse to host any content that violates these Terms or our Acceptable Use Policy. We employ an escalating enforcement process: repeated violations may result in warnings, content removal, and ultimately account termination. Kendrick may act on violations at its sole discretion and without prior notice.
You represent that you have the right to use all content you submit. You must not upload, submit, or request content that infringes on the intellectual property rights of any third party.
If you believe content hosted on the Service infringes your copyright, you may submit a takedown notice to our designated agent at support@kendrick.site. Your notice must include: (a) identification of the copyrighted work, (b) identification of the infringing material and its URL, (c) your contact information, (d) a statement of good faith belief that the use is unauthorized, and (e) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized to act on their behalf.
Certain features of the Service require a paid subscription. Subscriptions are billed in advance on a recurring monthly basis through our payment processor. When your subscription begins (after any free trial period), you are charged immediately for the upcoming billing period. By subscribing, you authorize recurring charges until you cancel. You may cancel your subscription at any time; if you cancel before the next renewal date, you will receive a pro-rated refund for the unused portion of your current billing period. Trial accounts are provided at no cost and are subject to usage limits as described on our pricing page. Free trial sites go offline 15 days after creation if the account has not been upgraded to a paid plan. After a site goes offline, you have an additional 15-day grace period during which you can upgrade your account to restore the site. After the grace period (30 days total from creation), the site and its content are permanently deleted.
Kendrick reserves the right to modify or discontinue the free trial at any time.
Websites are hosted on kendrick.site subdomains by default. Custom domains are available on paid plans. Kendrick does not guarantee 100% uptime and is not liable for temporary service interruptions.
Either party may terminate at any time. You may close your account by contacting us at support@kendrick.site. Upon termination, your websites will be taken offline. Deleted sites are retained for 15 days before permanent deletion, during which you may request restoration via the rescue link provided in your deletion confirmation email.
Kendrick may suspend or terminate your account immediately if you violate these Terms. In the event of termination for cause, no refund will be issued.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KENDRICK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENDRICK’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO KENDRICK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL KENDRICK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
You agree to indemnify, defend, and hold harmless Kendrick Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party rights.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.
We may update these Terms from time to time. When we make material changes, we will notify you by email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
